Workplace accidents: 2 dead, 1 injured at road construction site

A recent California car crash resulted in the tragic death of two road construction workers and injury to a third construction worker. Workplace accidents like these happen all too often, especially at night. This incident took place just after 3:30 a.m. on the San Diego Freeway in Torrance, California, even though the area was apparently well lit.

The two workers, ages 56 and 58, were killed after a Ford Explorer rear-ended a Lexus SUV that had apparently been slowing down due to the San Diego Freeway construction area. Despite having slowed down, the Lexus and the Ford both veered into the construction zone, killing the workers. The third injured worker was sent to a local hospital with minor to moderate injuries.

No information was immediately available on either SUV driver. However, they each complained of neck and back pain in addition to suffering minor lacerations. They were both taken to the hospital and also arrested on suspicion of drinking and driving. Both drivers may be charged with involuntary manslaughter.

Typically, family members of deceased workers have a right to workers’ compensation death benefits under workers’ compensation law, which may help them with the financial burden created by the workplace accidents. The injured construction worker also may be eligible for benefits, as he may lose time at work from the injuries sustained due to the accident. In addition to any benefits available, the surviving families and injured worker retain their rights to claim monetary damages from the two drivers whose alleged negligence resulted in the unfortunate fatalities and injuries.
