Fatal workplace injuries claims life of construction worker

Construction worker fatalities nationwide, including in California, are a matter of growing concern. Construction company owners must limit potential workplace injuries and follow the strict safety regulations that are prescribed by the Occupational Safety and Health Administration. Not only must workers be made aware of the dangers to which they may be exposed, but they must also be provided with safety equipment and training in how to properly use the equipment.

A construction worker recently lost his life on a construction site of a casino in another state. The 56-year-old worker was apparently on a man lift platform when he fell approximately 38 feet to the ground. The circumstances that caused the fall have not been made available, but OSHA has reportedly launched an investigation into the accident.

A spokesperson for the sheriff’s department said it is suspected the worker’s death was instant. It was not mentioned whether the worker was wearing a fall protection harness at the time of the accident. The OSHA investigators will likely determine whether this tragic death was the result of safety violations. The local residents on the Indian Reservation where the casino was being built have reportedly been against the construction of the multi-million dollar project since its inception in the 1990’s because of the impact it would have on their tranquil, rural surroundings.

Any family, in California or elsewhere, who has lost a loved one due to fatal workplace injuries that were suffered in an on-the-job accident may pursue compensation for end-of-life expenses. The workers’ compensation insurance fund provides death benefits to the dependents of deceased workers. The benefits typically cover the costs of a funeral and burial, and also a financial package that is based on the worker’s income level. While no amount of money can fill the void left by the loss of a loved one, the compensation may relieve the financial burden of day-to-day living expenses. However, if the death occurred at a site that is located on an Indian Reservation, the family may have all the more reason  to consult with an experienced workers’ compensation attorney to assess the applicability of tribal and state compensation laws to their circumstances.
